£10,000 Fine For Duo Who Permitted Waste to be Burned at Car Boot Site

The CPN which was issued in 2017 required them: –

• To cease immediately the burning of waste or permitting waste to be burned on all car boot sale sites they operated within North Warwickshire.
• All waste awaiting disposal on car boot sale sites be stored in lockable skips or containers.
• All waste removed from car boot sale sites within North Warwickshire be removed by a registered waste carrier.

They were each charged with failing to comply with the CPN in that waste was not stored in lockable skips or containers and waste was permitted to be burned on 14th July 2019 and on or before 5th August 2019 at the Haunch Lane, Lea Marston site; on or before 5th August 2019 at the Cuttle Lane Wishaw site; and, on or before 13th August 2019 at the Birmingham Road, Coleshill site.

The Court heard evidence given by the North Warwickshire Borough Council’s Environmental Health Investigating Officer and a Crew Commander of Warwickshire Fire and Rescue Service who had attended several fires at the 3 sites.  On behalf of the Defendants, the Court heard evidence from an owner of one of the sites, and Mr Andrew Walsh, Mr James Taroni and their witness Mr Richard Taroni.

The Court found Mr Andrew Walsh and Mr James Taroni guilty of the 4 offences and imposed the following sentence:

Mr Walsh was fined                                                     £ 3,000

Mr Taroni was fined                                                     £ 2,000

Both were ordered to pay Investigation & Legal Costs £ 5,000

Total                                                                           £10,000

North Warwickshire Borough Council takes breaches of Community Protection Notices and illegal disposal of waste extremely seriously and will not hesitate to prosecute offenders.”
